Terms of Use

These Terms govern your use of Creatyvot, a WhatsApp CRM and automation platform that acts as a connection bridge between Meta's WhatsApp Business Platform, your business, your CRM, and your customer communication workflows. Please read them carefully before using the service.
1. Acceptance of Terms
By accessing or using Creatyvot, creating an account, connecting a WhatsApp Business asset, installing a Meta app, using an API, sending a campaign, managing contacts, or using any related feature, you agree to these Terms. If you use Creatyvot on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 18 years old, or the age of majority in your location, and legally able to enter into contracts. Creatyvot is intended for business use, and each user must be authorized by the business owner or workspace administrator to access the account.
If you do not agree to these Terms, you must not use the service. We may update these Terms from time to time, and continued use after an update means you accept the updated Terms from their effective date.
2. Description of Service
Creatyvot provides software for WhatsApp CRM, shared inbox, contact management, message templates, broadcasts, automation, integrations, team collaboration, analytics, and customer communication workflows. Our role is to provide a secure technology bridge between Meta's WhatsApp Business Platform and your business systems so you can expand, support, and manage customer relationships more efficiently.
Creatyvot is not Meta, WhatsApp, or your telecommunications provider. We do not own the WhatsApp Business Platform, control Meta's approval process, control WhatsApp delivery infrastructure, or guarantee that Meta will approve a business, app, phone number, template, permission, or feature.
3. Accounts, Access, and Authority
You must provide accurate, complete, and current account information. You are responsible for maintaining the confidentiality of your login credentials, controlling access to your workspace, assigning appropriate user roles, and all activity that occurs under your account.
You must only connect WhatsApp Business Accounts, phone numbers, Meta Business assets, CRMs, contact lists, domains, and integrations that you own or are authorized to use. If your authorization ends, you must disconnect the relevant assets and stop using Creatyvot for those assets immediately.
The CRM owner or workspace administrator may create multiple role-based agents, invite users, assign permissions, restrict features, and control which users can view conversations, send messages, manage campaigns, export data, configure automations, connect integrations, access billing, or change workspace settings. The owner is responsible for choosing appropriate permissions and reviewing access regularly.
Actions taken by users, agents, administrators, contractors, staff, or other persons who are invited to or permitted inside your workspace are treated as actions authorized by the workspace owner or business. The owner and business are responsible and liable for messages sent, campaigns launched, data exported, contacts modified, integrations connected, automations configured, settings changed, or any other activity performed by permitted users under the account.
You are responsible for securely storing and protecting your own passwords, administrator credentials, Meta Business credentials, CRM credentials, API keys, webhook secrets, third-party app tokens, recovery codes, connected devices, and payment account access. You must keep credentials confidential, use strong authentication where available, remove access for former users, rotate compromised credentials, and avoid sharing access details through insecure channels.
4. Meta Approval and Platform Dependencies
Certain Creatyvot features depend on Meta review, Meta app approval, business verification, WhatsApp Business Account status, phone number status, template approval, messaging limits, payment setup, webhook permissions, and Meta's technical availability. You acknowledge that Meta may approve, reject, limit, suspend, revoke, or change access at any time under Meta's own rules.
We may assist with technical connection steps, configuration, documentation, and operational guidance, but we cannot guarantee Meta approval or restore access that Meta restricts. Any delay, rejection, suspension, template failure, account restriction, quality rating change, or policy enforcement action taken by Meta is outside our control.
Creatyvot may provide reasonable support, troubleshooting, issue review, configuration help, and guidance for Meta-related issues. Where practical, we may help you prepare information, retrieve relevant logs or status details, contact Meta support, or follow up with Meta support about business verification, app review, templates, phone numbers, webhooks, permissions, or account restrictions. This support does not guarantee resolution, response time, approval, restoration, or a particular outcome from Meta.
Meta may reject business verification, move a business, phone number, app, template, or WhatsApp Business Account into review, reduce messaging limits, pause approvals, or suspend access when Meta detects policy risk, incomplete information, unusual activity, customer complaints, or suspected violations. Creatyvot is not liable for Meta review outcomes, approval delays, verification rejection, account restrictions, campaign disruption, or loss of access caused by Meta's review process or your policy compliance status.
Meta business verification is a Meta-controlled process between Meta and your business or customer-side Meta Business account. Meta may take several days, longer periods, or an unknown amount of time to approve, reject, request documents, pause, or move verification into additional review. Creatyvot is not responsible for Meta's verification timeline, verification delays, under-review status, rejected verification, or any resulting inability to use WhatsApp Business Platform features.
5. Customer Responsibilities
You are responsible for your use of Creatyvot and for all content, campaigns, automations, and data processed through your account. You agree to:
- obtain valid consent before messaging customers where consent is required;
- honor opt-outs, unsubscribe requests, and customer communication preferences promptly;
- send only lawful, accurate, non-deceptive, and expected messages;
- use approved WhatsApp templates only for their approved purpose and category;
- avoid spam, harassment, illegal goods or services, prohibited content, and abusive automation;
- keep contact lists accurate and avoid uploading data you do not have rights to use;
- comply with privacy, telecom, marketing, consumer protection, data protection, and industry-specific laws;
- train your team and control who can send messages, export data, connect integrations, or change settings.
If your business handles regulated data, such as healthcare, financial, education, children's, government, employment, biometric, or other sensitive information, you are responsible for confirming that Creatyvot, WhatsApp, Meta, AI providers, and connected third-party systems are appropriate for that use and that all required notices, consents, contracts, safeguards, and legal obligations are satisfied.
6. Meta Policy Violations
You must comply with all applicable Meta and WhatsApp policies, including commerce, business, messaging, template, opt-in, prohibited content, quality, and platform rules. If you violate Meta's policies, Meta may reject templates, reduce quality ratings, limit messaging, disable a phone number, suspend an app, restrict a WhatsApp Business Account, revoke permissions, or take other enforcement action.
Creatyvot is not responsible for losses, interruptions, restrictions, penalties, customer complaints, delivery failures, approval failures, account suspensions, or business impact caused by your violation of Meta policies, applicable law, customer consent requirements, or acceptable use rules. Those matters are handled by Meta, WhatsApp, regulators, carriers, payment providers, or other relevant platforms.
Campaigns may fail, pause, underperform, or be blocked for reasons outside Creatyvot's control, including Meta template rejection, template category changes, account quality issues, messaging limits, customer opt-outs, insufficient Meta balance or payment issues, invalid numbers, delivery restrictions, user complaints, commerce policy issues, webhook delays, WhatsApp outages, or Meta enforcement actions. You remain responsible for campaign content, audience quality, opt-in status, and compliance.
7. Coexistence and Regular WhatsApp API
Creatyvot may support businesses using regular WhatsApp Business Platform API workflows and, where available, WhatsApp Business App coexistence. Coexistence and regular API usage are different operating models with different availability, limitations, migration behavior, message history behavior, device behavior, billing, feature support, and Meta requirements.
You understand that coexistence is subject to Meta's rules and technical availability. Creatyvot can only access, display, sync, automate, or process the data that Meta makes available through approved APIs and permissions. We do not guarantee that every WhatsApp Business App feature, historical message, contact, label, or device-side action will appear in Creatyvot.
In coexistence or API-connected setups, Meta may disconnect, expire, limit, or require reconnection of a WhatsApp connection because of inactivity, device state, token expiry, permission changes, security review, product changes, or other Meta-controlled reasons. If this happens, you may need to reconnect WhatsApp with Creatyvot before inbox, automation, chatbot, campaign, sync, or CRM features can continue working normally.
8. Data, Privacy, and Security
You retain ownership of the customer data, CRM records, message content, templates, files, contact lists, and business information you provide to Creatyvot. You grant us the limited rights necessary to host, process, transmit, display, secure, support, and improve the service for your authorized use.
We use reasonable safeguards, including encryption in transit and appropriate encrypted storage practices, access controls, logging, monitoring, and operational security controls. You are responsible for using strong passwords, protecting devices, limiting team permissions, reviewing integrations, and ensuring your own systems are secure.
Creatyvot may use MongoDB Atlas for managed database hosting, replication, monitoring, and continuous or scheduled backup capabilities. We may also use Cloudflare services for security, DNS, traffic protection, firewall rules, DDoS mitigation, bot protection, performance, monitoring, routing, and backup or recovery-related services where configured.
We may offer Google one-click login or signup to make account access faster. If you choose to use Google login, your use of that authentication method is also subject to Google's applicable terms and privacy practices, and you are responsible for keeping your Google account secure.
Creatyvot is a multi-tenant SaaS platform. We use logical workspace isolation, account boundaries, authorization checks, role-based permissions, and tenant-aware data access controls to separate customer data. You must not attempt to access another customer's workspace, data, API keys, integrations, conversations, contacts, files, billing information, or connected assets.
You are responsible for configuring your own workspace access, user roles, connected CRMs, webhook endpoints, chatbot providers, exported data, and internal security practices. If your users, devices, shared credentials, integrations, or exported files expose your data, that exposure is your responsibility unless it was caused by Creatyvot's breach of these Terms or applicable law.
9. User-Provided Apps, APIs, and Automation Flows
Creatyvot may allow you to connect third-party applications, APIs, webhook endpoints, automation tools, n8n flows, external CRMs, ecommerce platforms, order systems, payment tools, helpdesks, analytics tools, custom backend services, lead forms, or other systems selected and provided by your business.
By connecting a third-party app or API, you authorize Creatyvot to exchange data with that system as required by the integration or workflow you configure. This may include sending, receiving, syncing, updating, transforming, or triggering customer data, CRM data, WhatsApp conversations, message status events, order data, tags, notes, assignments, webhook payloads, chatbot outputs, and other business workflow information.
We use reasonable safety measures for integrations, including authorization checks, tenant isolation, encrypted transport where supported, secure credential handling practices, permission controls, logs, and workflow boundaries. You are responsible for configuring integrations safely, limiting access to only the data required, rotating credentials when needed, validating webhook destinations, testing n8n or automation flows before production, and preventing accidental data sharing.
Creatyvot may provide APIs, webhook events, webhook endpoints, access tokens, documentation, and integration tools so you can connect external applications. If you use these APIs or webhooks, you are responsible for the external app, endpoint, server, code, credentials, request handling, response handling, data mapping, security, uptime, and compliance of that connected system.
Third-party apps, APIs, ecommerce platforms, external CRMs, automation tools, n8n flows, and webhook endpoints are governed by their own terms, privacy policies, retention rules, security practices, and availability. Creatyvot is not responsible for data loss, data exposure, incorrect syncs, failed orders, broken automations, duplicate records, unauthorized third-party access, webhook delivery failures, incorrect API usage, endpoint downtime, third-party bugs, rate limits, rejected requests, corrupted payloads, or compliance issues caused by systems that you connect, configure, own, or authorize. Liability for third-party or user-provided API and webhook issues remains with the user or business that connected those systems.
10. AI Chatbot and Conversation Data Agreement
If you enable an AI chatbot, AI assistant, auto-reply workflow, conversation summary, intent detection, CRM update automation, or third-party AI integration, you authorize Creatyvot to process and share the relevant conversation data with the selected AI system for the purpose of providing that feature.
Creatyvot may allow you to choose the AI provider used for chatbot conversations, including providers such as ChatGPT/OpenAI, Gemini/Google, or another supported AI provider. By selecting or connecting an AI provider, you authorize Creatyvot to send the required chatbot conversation data to that provider and you agree that the provider's own terms, privacy policy, data retention settings, security practices, and model training options may apply.
Conversation data shared for AI features may include customer messages, agent replies, customer names, phone numbers, CRM notes, lead details, tags, message history, attachments, metadata, business knowledge base content, prompts, and instructions configured by your team. You are responsible for choosing what data is connected to the chatbot, selecting an AI provider appropriate for your business and compliance needs, and making sure the chatbot has only the access it needs.
You agree that your business is responsible for providing any required customer notice, consent, agreement, opt-out option, or other lawful basis before using AI in customer conversations. You must not use chatbot features to process data you are not authorized to use, secretly monitor customers where disclosure is required, make prohibited automated decisions, or generate responses that violate law, Meta policy, WhatsApp policy, customer rights, or industry rules.
AI-generated responses may be inaccurate, incomplete, delayed, unsafe, or unsuitable for a particular customer. You are responsible for testing chatbot behavior, monitoring conversations, setting appropriate fallback rules, reviewing sensitive replies, and ensuring a human can intervene where needed. Creatyvot is not responsible for business losses, customer claims, compliance failures, or incorrect commitments caused by chatbot configuration, prompts, training material, AI provider behavior, or automated responses approved or deployed by your business.
Chatbots, automations, auto-replies, n8n flows, webhooks, or CRM sync workflows may stop, pause, delay, or fail in rare situations if Meta disconnects or requires reconnection, if your WhatsApp connection becomes inactive, if tokens or permissions expire, if a third-party provider is unavailable, if your subscription is inactive, or if security controls disable a workflow. You are responsible for monitoring important automations and reconnecting or reactivating services when required.
11. Data Deletion and Retention
You may request deletion of eligible workspace, customer, WhatsApp, or CRM data. After a valid deletion request or account closure, we will delete or anonymize eligible production data within 60 days, unless retention is required or permitted for legal compliance, tax, billing, fraud prevention, security, dispute resolution, backups, abuse prevention, or legitimate business records.
We may retain audit logs, access logs, billing records, security events, abuse investigation records, API logs, webhook logs, message delivery records, and operational metadata for longer periods where needed for security, legal compliance, fraud prevention, dispute resolution, tax records, platform reliability, or legitimate business purposes.
Backup copies may remain temporarily until overwritten or removed through normal backup cycles. Data held by Meta, WhatsApp, connected CRMs, payment providers, analytics tools, or other third parties is governed by those providers' own deletion and retention rules.
12. Fees, Billing, and Third-Party Charges
You agree to pay all fees associated with your selected plan, usage, add-ons, and paid features. Meta, WhatsApp, cloud providers, CRMs, payment processors, or other third parties may charge separate fees, including conversation charges, template-related charges, phone number charges, usage charges, taxes, or integration fees. Unless expressly stated, those third-party charges are not included in Creatyvot fees.
Subscriptions may renew automatically for the billing period shown at checkout, on the invoice, or in the subscription settings unless cancelled before renewal. Cancellation stops future renewal charges but does not automatically refund the current billing period. Access may continue until the end of the paid period unless the account is suspended or terminated for another reason.
Creatyvot subscription payments may be processed by third-party payment processors, banks, card networks, UPI providers, or billing platforms. Creatyvot does not store full card numbers where payments are handled by a payment processor. Payment processors may handle card details, authentication, refunds, disputes, chargebacks, taxes, and payment verification under their own terms and security practices.
Prices may exclude taxes, levies, duties, GST, VAT, withholding, payment gateway fees, currency conversion charges, bank charges, or government fees unless expressly stated. You are responsible for taxes and charges that apply to your purchase, subscription, location, payment method, or business use.
We may change plan names, included features, user limits, automation limits, storage limits, add-on prices, setup fees, support scope, or subscription pricing from time to time. Changes may apply immediately to new purchases and may apply to existing subscriptions at renewal or after reasonable notice, unless a written agreement states otherwise.
Each Creatyvot plan may include a specific number of extra users or agents who can work on the same connected WhatsApp number or workspace, as described on the applicable plan, invoice, order form, or subscription page. If you need more users, agents, seats, or team members than your plan includes, you may add them through a paid add-on subscription, subject to the pricing and limits shown at the time of purchase.
If you request business automation, custom workflow setup, n8n flow setup, CRM/ecommerce automation, chatbot configuration, campaign setup, integration mapping, or similar implementation work from Creatyvot, that service may be charged as a separate one-time setup fee. This one-time automation or setup fee can be added while subscribing to a plan as an add-on service and is separate from recurring subscription fees, Meta charges, and third-party charges.
Meta template message pricing, conversation charges, campaign message charges, taxes, payment failures, refunds, credits, billing thresholds, and WhatsApp Business Platform payment methods are handled by Meta under Meta's own pricing and payment rules. Creatyvot does not manage, store, or control the card details or payment methods you provide directly to Meta for WhatsApp messaging payments.
Failure to pay fees may result in downgrade, suspension, feature restrictions, data export limitations, or termination of service, subject to applicable law and any written agreement between you and us.
Creatyvot subscription fees are separate CRM/platform fees and are not dependent on Meta approval, business verification success, template approval, campaign delivery, account quality, messaging limits, third-party integrations, or external platform availability. Meta review, Meta policy rejection, WhatsApp account restriction, third-party app failure, ecommerce issue, CRM sync problem, n8n flow failure, or any other external third-party scenario does not automatically waive or refund Creatyvot subscription fees.
We currently do not provide refunds for subscription charges except where required by applicable law or expressly agreed in writing by Creatyvot. After WhatsApp is connected, our servers may continuously receive, process, store, index, secure, and back up message events, delivery statuses, webhook events, CRM changes, logs, and related records, even when you are not actively using the dashboard. These ongoing infrastructure, storage, backup, monitoring, and server costs are part of the reason subscription charges are not refundable for unused time, non-use, external review delays, Meta rejections, or third-party service issues.
13. Acceptable Use
You must not use Creatyvot to:
- send spam, phishing, malware, scams, deceptive messages, or unauthorized marketing;
- sell or promote prohibited goods, illegal services, or content banned by Meta or law;
- harass, threaten, impersonate, mislead, or exploit any person;
- upload data obtained without lawful rights, consent, or authority;
- use AI chatbot features without required customer notice, consent, agreement, or lawful basis;
- attempt to bypass Meta limits, template review, quality controls, or platform restrictions;
- reverse engineer, scrape, overload, attack, or interfere with Creatyvot or connected platforms;
- share credentials, tokens, API keys, or workspace access with unauthorized parties;
- use the service in a way that could harm Creatyvot, Meta, WhatsApp, customers, or other users.
We may monitor, investigate, rate-limit, block, suspend, or disable activity that appears to involve spam, abuse, security threats, unauthorized access, excessive usage, illegal content, Meta policy risk, suspicious automation, or harm to the platform, customers, Meta, WhatsApp, or third parties.
14. Suspension and Termination
We may suspend or terminate access if we believe your use creates security risk, legal risk, policy risk, platform abuse, unpaid fees, data misuse, customer harm, Meta policy exposure, or harm to Creatyvot or other users. We may also restrict features if required by Meta, law, court order, regulator request, or infrastructure provider.
If your subscription expires, is cancelled, is unpaid, or becomes inactive, Creatyvot may automatically deactivate active chatbots, automations, campaigns, integrations, or other paid features. After renewal or reactivation of the subscription, you may need to manually review, reconnect, and reactivate chatbots, automation rules, integrations, or workflows before they resume.
You should export any data, reports, contacts, message history, files, invoices, or business records you need before cancelling, deleting, or closing your workspace. After suspension, termination, deletion, subscription expiration, or the end of a retention period, data may no longer be available for export or recovery.
We may archive, restrict, suspend, or delete inactive, abandoned, unpaid, or unused accounts after reasonable notice where practical, especially where continued storage creates security, cost, compliance, or operational risk. Reopening an inactive account may require payment, verification, reconnection of WhatsApp assets, or reactivation of integrations.
Upon termination, you must stop using the service and disconnect unauthorized integrations. We may provide reasonable access for export where practical, unless prohibited by law, security concerns, non-payment, abuse investigation, or third-party platform restrictions.
15. Intellectual Property
Creatyvot and its licensors own the service, software, interface, designs, workflows, documentation, trademarks, features, and related intellectual property. You may not copy, modify, resell, sublicense, reverse engineer, or create competing products from Creatyvot except as allowed by law or written permission.
You retain rights to your business data and content. You are responsible for ensuring that any content, templates, media, customer data, trademarks, or materials uploaded to Creatyvot are lawful and that you have the required rights to use them.
We will not use your business name, logo, public review, testimonial, case study, screenshots, or customer story in marketing materials without permission, unless your business information is already publicly available or use is otherwise permitted by law or a written agreement.
16. Service Availability and Changes
We work to keep Creatyvot reliable, but the service may be unavailable because of maintenance, updates, security work, outages, internet issues, cloud provider incidents, Meta outages, WhatsApp changes, third-party failures, or events beyond our control. We may add, remove, modify, suspend, or discontinue features as the product, security needs, laws, or Meta platform requirements evolve.
Support is provided on a commercially reasonable basis unless a separate written agreement states a specific support plan, response time, or service level. We do not guarantee immediate support, continuous monitoring of your campaigns, or manual recovery of automations unless expressly included in your plan or a written service agreement.
Some features, including AI, chatbot, coexistence, automation, integrations, analytics, or newly released tools, may be beta, experimental, limited, or dependent on third-party platforms. These features may change, fail, be restricted, or be removed without creating a refund obligation.
If Creatyvot offers an integration directory, marketplace, app list, connector library, template gallery, or recommended third-party tool, those listings are for convenience and do not make the third-party service part of Creatyvot. Each third-party app remains responsible for its own service, pricing, privacy, security, availability, support, and compliance.
We are not responsible for delay, failure, outage, data delay, delivery issue, or non-performance caused by events outside our reasonable control, including Meta or WhatsApp outages, MongoDB Atlas incidents, Cloudflare incidents, cloud provider failures, internet or telecom failures, power issues, government action, legal restrictions, cyberattacks, war, disasters, labor disruption, or third-party platform changes.
17. Disclaimers
Creatyvot is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, fully compatible with every third-party system, or that Meta, WhatsApp, CRMs, carriers, or other providers will continue to provide access on the same terms.
We do not provide legal advice. Any guidance about Meta approval, privacy, messaging compliance, opt-ins, or templates is operational information only. You should consult qualified professionals for legal, regulatory, tax, or compliance advice specific to your business.
18. Limitation of Liability
To the maximum extent permitted by law, Creatyvot and its directors, employees, partners, agents, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, customers, business opportunity, or platform access, arising from your use of or inability to use the service.
We are not liable for Meta enforcement actions, WhatsApp delivery failures, template rejection, messaging limits, account bans, customer complaints, third-party service failures, data entered by your team, unlawful campaigns, or violations of law or platform policy by your business.
19. Indemnity
You agree to defend, indemnify, and hold harmless Creatyvot from claims, damages, liabilities, penalties, costs, and expenses arising from your content, customer data, campaigns, integrations, violation of these Terms, violation of law, violation of Meta policies, misuse of the service, or infringement of third-party rights.
20. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Courts with competent jurisdiction in India will have authority over disputes unless a separate written agreement between you and Creatyvot states otherwise.
21. Changes to These Terms
We may modify these Terms to reflect product changes, legal requirements, security practices, business updates, or Meta platform changes. If a change is material, we will take reasonable steps to notify you. Continued use after the effective date means you accept the updated Terms.
